Terms of Service

1. About BASKET

BASKET is a Software-as-a-Service (SaaS) platform operated by K2026377101 (South Africa), providing digital giving infrastructure to registered South African churches and faith-based organisations, and event ticketing infrastructure to South African schools. BASKET enables congregations to give, and parents and supporters to buy tickets, via WhatsApp, QR code, and web payment links.

2. Eligibility

To use BASKET, you must:

• Be a registered church, faith-based organisation, Public Benefit Organisation (PBO), or school in South Africa
• Have a valid South African bank account in your organisation's name
• Be the person duly authorised to enter into agreements and manage this account on behalf of your organisation
• Comply with all applicable South African laws and regulations

3. Subscription and Fees

BASKET charges fees based on your organisation type and chosen plan.

For churches:

• Basic Basket: R249/month — branded giving page, QR code, WhatsApp giving via BASKET number, once-off and monthly giving, multiple giving accounts, full dashboard
• Full Basket: R499/month — everything in Basic Basket plus BASKET Tickets and Church Menu Builder

For schools:

• Per event: R399 once-off per published event
• Monthly: R399/month for unlimited events

All monthly subscription fees are charged in advance. BASKET does not charge transaction fees on congregation giving or ticket sales — only Paystack's standard payment processing fee applies. Current Paystack fees are available at paystack.com/za/pricing.

Subscriptions auto-renew monthly unless cancelled. You may cancel at any time with 30 days notice.

4. Payment Processing

All payments are processed by Paystack, a licensed payment service provider. By using BASKET, you also agree to Paystack's Terms of Service. BASKET does not store card details or handle funds directly — all giving and ticket sales go directly to your registered organisation's bank account via Paystack's subaccount infrastructure.

5. Your Responsibilities

As a BASKET subscriber, you agree to:

• Provide accurate and truthful information about your organisation
• Only use BASKET to receive legitimate offerings, donations, or event ticket sales
• Keep your login credentials secure and confidential
• Notify BASKET immediately of any unauthorised use of your account
• Comply with all applicable financial regulations including FICA and POPIA
• Not use BASKET for any commercial, illegal, or fraudulent purpose

6. BASKET's Responsibilities

BASKET agrees to:

• Maintain the platform with reasonable uptime (targeting 99% availability)
• Keep your data secure and confidential
• Process your launch kit within 24 hours of successful signup
• Provide email support within 2 business days
• Notify you of any significant changes to the service with 30 days notice

7. Intellectual Property

BASKET and all associated software, branding, and content are the intellectual property of K2026377101 (South Africa). You may not copy, reproduce, or distribute any part of BASKET without written permission.

8. Data Protection

BASKET complies with the Protection of Personal Information Act (POPIA) of South Africa. Your data is never sold to third parties. Please see our Privacy Policy for full details.

9. Termination

BASKET reserves the right to suspend or terminate any account that:

• Violates these Terms of Service or the Acceptable Use Policy
• Is involved in fraudulent or illegal activity
• Has overdue subscription payments
• Provides false information during registration

Upon termination, you will retain access to your transaction and ticket sales history for 90 days.

10. Limitation of Liability

BASKET is not liable for any indirect, incidental, or consequential damages arising from your use of the platform. BASKET's total liability is limited to the subscription fees paid in the 3 months preceding any claim.

11. Changes to Terms

BASKET may update these Terms of Service from time to time. You will be notified by email at least 30 days before any material changes take effect. Continued use of BASKET after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of South Africa.
